Photoshoot Agreement
This is a binding contract between you (”the Client”) and M. Freddy, and any modifications must be in writing, signed by both parties. This Agreement supersedes all prior agreements and understandings, oral, written and implied, between the parties hereto with respect to the subject matter hereof. In the event that any part of this agreement is found to be invalid or unenforceable, the remainder of this agreement shall remain valid and enforceable. Any agreement to waive one or more provisions of this agreement or any failure by one or both parties to enforce a provision of this agreement shall not constitute a waiver of any other portion or provision of this agreement.
Authorization: You must have the authority and authorization to sign on behalf of all participants of the photoshoot session.
Reservation: A signed contract and payment in full is required to reserve the date and time of the photoshoot.
Deliverables: Digital scans of 3 photographs selected by M. Freddy, from 1 pack of instant film (10 shots). The photoshoot does not include negatives (i.e. the physical polaroid).
Refund: Once a balance is paid, it is non-refundable. You may reschedule a photoshoot once, but you must provide notice at least 72 hours before the photoshoot. M. Freddy is not responsible if key individuals fail to appear or cooperate during photoshoots.
Shooting time: The photoshoot begins at the scheduled start time. M. Freddy offers a grace period of up to 30 minutes, provided that the Client notifies M. Freddy of the expected delay prior to the scheduled photoshoot time.
Permits: The Client is responsible for acquiring all permits and necessary permission e.g. permits for photographing at certain locations.
Creative license: M. Freddy will make his best effort to honour requested photographs, but does not guarantee any specific photograph, lighting, or image, nor incorporate any specific background.
Copyright: English Copyright Law declares that the copyright remains with the photographer. The photographer grants the Client a limited license to use the photographs from the photoshoot for the following purposes: social media and websites, provided that (1) the Client credits M. Freddy in writing whenever the photograph(s) are used, (2) the Client does not sell the photograph(s), or use the photograph(s) on merchandise or products for sale, and (3) the Client does not alter, retouch, or edit the photograph without the express written permission of M. Freddy.
Model release: The Client grants M. Freddy the irrevocable and unrestricted right to use and publish photographs of the Client or in which the Client may be included, for editorial, advertising, educational, and any other purpose and in any manner and medium; and to copyright the same without restriction. The Client waives any right to review or approve the photographs and waives any right to royalties or other compensation arising from or related to the use of the photographs.
Limitation of liability: In the unlikely event that M. Freddy is unable to perform to the guidelines of this contract due to an injury, illness, act of God, or other cause beyond the control of M. Freddy, M. Freddy will make every effort to secure a replacement. If this is not possible, the responsibility and liability of M. Freddy is limited to the return of all payments received for the photoshoot. In the unlikely event that the photographs have been lost, stolen, or destroyed for reasons within or beyond M. Freddy’s control, the responsibility and liability of M. Freddy is limited to the return of all payments received for the photoshoot. M. Freddy is not liable for indirect or consequential loss.
Personal accident: Any directions issued to the Client or the participants of the photoshoot are deemed to be at said persons’ own risk. M. Freddy cannot be held responsible for any personal accidents during a photoshoot.
Country of Jurisprudence: This Contact is made under, and subject to, English Law.
